What Is a Grant of Probate?
A grant of probate is the court order that confirms an executor's legal authority to administer the deceased's estate. Until it's granted, banks, Land Information New Zealand and other institutions generally won't release the deceased's assets — so for most estates, obtaining a grant of probate is the first practical step.
In New Zealand, every probate application is filed with the Wellington High Court Probate Registry, no matter where you live. A grant of probate is issued once the Registry is satisfied the will is valid and you are the executor named in it. Simply Probate prepares your complete application — the probate application form, the supporting affidavits, and all the other court documents — ready for you to file with the Wellington Probate Registry yourself, in person or by post.
Once your application is filed, a grant of probate is typically issued within about two weeks. From that point you can deal with the estate's bank accounts, transfer property, and distribute what's left to the beneficiaries.
